Tellier had contacted the carpenter over building violations. He presented a card of the carpenter and his building permit, but an argument developed. Beausoleil, the carpenter, upset over a dispute about his shop, walked to his truck and retrieved a 12-gauge shotgun. He returned to the building and ordered the building inspector to get out of his shop and off his premises. As Tellier walked away, Beausoleil poked the barrel of the shotgun into Tellier's back to push him along towards the door. As he reached the door, the gun discharged, hitting Tellier in the back at close range and killing him instantly.
